Clients represent that they have the right to provide this information and authorize Webstarz to use it for website development, hosting coordination, marketing setup, and related services.

4. Website Forms and Leads

Clients are responsible for how they collect, use, store, respond to, and protect information submitted through their own website forms.
5. Payment Information
Payments may be processed through third-party payment processors. Webstarz may receive limited billing details such as payment status, subscription status, transaction history, billing name, email address, and partial payment information.
Webstarz does not intentionally store full credit card numbers on its own systems. Payment processing is subject to the privacy policies and security practices of the applicable payment processor.
6. Third-Party Services
Webstarz may use third-party platforms and vendors to provide services, including website builders, hosting providers, CRM systems, email providers, domain registrars, payment processors, analytics tools, IDX providers, MLS-related vendors, form tools, scheduling tools, and communication platforms.

Clients are responsible for ensuring that their own websites, forms, tracking tools, CRM systems, marketing communications, text messages, email campaigns, cookies, privacy notices, lead handling practices, and customer communications comply with applicable privacy laws.
Webstarz does not provide legal advice and does not guarantee compliance with the California Consumer Privacy Act, California Privacy Rights Act, GDPR, CAN-SPAM Act, Telephone Consumer Protection Act, state privacy laws, cookie consent laws, or other privacy regulations unless expressly agreed in writing.
12. Data Security
Webstarz makes reasonable efforts to use reputable platforms and service providers. However, no website, server, platform, CRM, payment processor, email system, form tool, plugin, or internet-connected service can be guaranteed to be completely secure.
Webstarz does not guarantee that information will be free from unauthorized access, loss, misuse, disclosure, alteration, destruction, malware, phishing, spam, outages, platform vulnerabilities, or third-party breaches.
13. Login Credentials and Account Access
Clients may provide login credentials, access links, domain credentials, hosting credentials, CRM access, website platform access, or other account access for setup or support purposes. Clients should provide only the access necessary for Webstarz to perform requested services.
Clients are responsible for maintaining secure passwords, enabling available security features, removing access when no longer needed, and monitoring their own accounts.
14. Data Retention
Webstarz may retain information for as long as reasonably necessary to provide services, maintain records, resolve disputes, enforce agreements, comply with legal obligations, prevent fraud, support business operations, and maintain backups.
Retention periods may vary depending on the type of information, service relationship, legal requirements, payment history, dispute status, and operational needs.
15. User Choices
Users may request access, correction, deletion, or limitation of certain personal information by contacting Webstarz or the applicable website owner. Requests may be subject to identity verification, legal limitations, business record requirements, contractual obligations, technical limitations, and applicable law.

Clients are responsible for ensuring that email marketing, text messaging, calls, newsletters, lead follow-up, CRM automations, and advertising communications comply with applicable laws and consent requirements.
Webstarz is not responsible for a client’s use of contact information, lead data, CRM campaigns, text messages, calls, or email marketing after information is submitted through a client website.
19. Business Transfers
If Webstarz is involved in a merger, acquisition, restructuring, sale of assets, financing, transfer, or similar business transaction, information may be transferred as part of that transaction.
20. International Users
Webstarz is based in the United States. If you access Webstarz services from outside the United States, you understand that information may be processed in the United States or other locations where our service providers operate.
